Corporate General Clarification Text Regarding the Processing of Personal Data

GioEV Şarj İstasyonları İşletmeleri Anonim Şirketi (“GioEV”) as; we have prepared this clarification text to inform you, our Visitors, Online Visitors, Customers, Potential Customers, Supplier Employees and Supplier Officials, regarding the processing, storage and transfer of your personal data within the scope of our activities arising from the Personal Data Protection Law No. 6698 (“KVKK”) and the relevant legislation and legal regulations.

1. What Personal Data Categories Do We Process and For Which Purposes Do We Process Them?

Your personal information may be processed by GioEV Şarj İstasyonları İşletmeleri Anonim Şirketi in accordance with the principles set forth in Article 4.2 of the KVKK;

  1. being processed lawfully and fairly,
  2. being accurate and, where necessary, up to date,
  3. being processed for specific, explicit and legitimate purposes,
  4. being relevant, limited and proportionate to the purposes for which they are processed,
  5. being retained for the period stipulated in the relevant legislation or required for the purpose for which they are processed,

within the scope of our established and ongoing business relationships with our business partners (it is possible for one person to fall into more than one category), in line with the purposes specified below.

A. Our Visitors

Identity information of our visitors (e.g. name, surname), physical venue security information (e.g. camera records);

  1. creating and tracking visitor records,
  2. ensuring physical venue security.

B. Our Online Visitors

Transaction security information of our online visitors using our website (e.g. your IP address information), marketing information (e.g. shopping history information, cookie records) and (if you provide them to us*) identity information, contact information (e.g. your e-mail address);

  1. conducting activities in accordance with the legislation,

  3. conducting communication activities,
  4. providing information to authorized persons, institutions and organizations,
  5. enabling your access to our website via the internet.

C. Our Customers

Identity information, contact information, customer transaction information (e.g. order information), physical venue security information, financial information (e.g. balance sheet information), legal transaction information, marketing information (e.g. shopping history information) of our individual customers or the officials and/or employees of our corporate customers;

  1. conducting activities in accordance with the legislation,
  2. conducting finance and accounting affairs,
  3. conducting/auditing business activities,
  4. conducting logistics activities,
  5. conducting after-sales support services for goods/services,
  6. conducting goods/services sales processes,
  7. conducting marketing analysis studies,

  9. providing information to authorized persons, institutions and organizations,

  11. resolving legal disputes,

Identity information, contact information, physical venue security information, customer transaction information, financial information, marketing information and legal transaction information of our individual suppliers or corporate supplier officials;

  1. conducting/auditing business activities,
  2. conducting goods/services procurement processes,
  3. conducting finance and accounting affairs,
  4. conducting contract processes,
  5. conducting investment processes,
  6. ensuring physical venue security,
  7. following up and conducting legal affairs.

2. What Are the Methods of Collecting Your Personal Data?

Your personal data specified above in categories are collected through physical means such as order forms, contracts and visitor forms, or through information systems and electronic devices (e.g. telecommunications infrastructure, computers and telephones), third parties (e.g. KKB and Findeks), our website and other documents declared by the data subject, by automatic or non-automatic means.

3. What Is the Legal Reason for Collecting Your Personal Data?

Your personal data are processed by GioEV Şarj İstasyonları İşletmeleri Anonim Şirketi, in line with the purposes explained above, based on the following legal grounds set forth in Article 5 of the KVKK;

  1. it is expressly provided for by laws,
  2. provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties to the contract,
  3. it is mandatory for the data controller to fulfill its legal obligation,
  4. data processing is mandatory for the establishment, exercise or protection of a right,
  5. provided that it does not harm the fundamental rights and freedoms of the data subject, data processing is mandatory for the legitimate interests of the data controller.

4. Do We Transfer Your Personal Data to a Third Party?

  1. Personal data of our visitors may be shared with law enforcement and judicial authorities for the purpose of resolving legal disputes and if requested pursuant to the relevant legislation.
  2. Personal data of our online visitors may be shared with judicial authorities and authorized public institutions and organizations for the purpose of resolving legal disputes and if requested pursuant to the relevant legislation.
  3. Personal data of our customers are transferred to authorized public institutions and organizations within the scope stipulated by legal regulations for the purposes of conducting activities in accordance with the legislation, following up and conducting legal affairs, and providing information to authorized persons, institutions and organizations; and, to the extent necessary for conducting/auditing business activities, conducting risk management processes and duly performing our services, to our group companies, information technology company, suppliers, cargo companies, insurance companies, banks and financial advisor. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities so that they may be used as evidence in any future legal disputes.
  4. Personal data of our potential customers may be transferred to the law office from which we receive services and to judicial authorities so that they may be used as evidence in any future legal disputes.
  5. Personal data of our supplier employee are transferred, within the scope stipulated by legal regulations, to authorized public institutions and organizations for the purposes of conducting activities in accordance with the legislation, following up and conducting legal affairs, providing information to authorized persons, institutions and organizations, and conducting/auditing business activities; and to group companies, the information technology company, suppliers, cargo companies, banks and our financial advisor to the extent necessary for the proper performance of the service. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities so that they may be used as evidence in any future legal disputes.
  6. Personal data of our supplier official are transferred, within the scope stipulated by legal regulations, to authorized public institutions and organizations for the purposes of conducting activities in accordance with the legislation, following up and conducting legal affairs, providing information to authorized persons, institutions and organizations, and conducting/auditing business activities; and to group companies, the information technology company, suppliers, cargo companies, banks and our financial advisor to the extent necessary for the proper performance of the service. In addition, such personal data may be transferred to the law office from which we receive services and to judicial authorities so that they may be used as evidence in any future legal disputes.

5. Do We Transfer Your Personal Data Abroad?

As GioEV Şarj İstasyonları İşletmeleri Anonim Şirketi, we do not transfer your personal data abroad.

6. How Can You Exercise Your Rights Regarding Your Personal Data?

You may submit your requests within the scope of Article 11 of the KVKK, which regulates the rights of data subjects, to us through the “Data Controller Application Form” prepared for your convenience in accordance with the “Communiqué on the Procedures and Principles of Application to the Data Controller” available at “https://gioev.com” belonging to GioEV Şarj İstasyonları İşletmeleri Anonim Şirketi.
